Terms of Service

These Terms of Service ("Terms") govern your access to and use of The ScentStack ("App"), a fragrance collection and layering mobile application operated by The ScentStack LLC, a Wyoming limited liability company ("Company," "we," "us," or "our"). By downloading, installing, or using the App, you agree to be bound by these Terms. If you do not agree, do not use the App.

You must be at least 13 years of age to use The ScentStack. By using the App, you represent that you meet this requirement. If you are under 18, you represent that you have your parent or guardian's permission to use the App.

To access certain features, you must create an account using email/password, Google Sign-In, or Sign in with Apple. You agree to provide accurate, current, and complete information during registration.

You are responsible for keeping your account credentials confidential and for all activity under your account. Contact hello@thescentstack.com if you suspect unauthorized use of your account.

Your session may persist across supported devices. Where the platform supports it, you may link an additional supported sign-in method to your existing account, and you can recover access to your account through password recovery where applicable.

The ScentStack grants you a limited, non-exclusive, non-transferable, revocable license to use the App for your personal, non-commercial purposes in accordance with these Terms.

You agree not to:

• Use the App for any unlawful purpose or in violation of applicable laws or regulations
• Reverse engineer, decompile, disassemble, or otherwise derive the source code of the App or its recommendation technology
• Scrape, crawl, or systematically extract data from the App
• Use the App to transmit harmful, offensive, or disruptive content
• Attempt to gain unauthorized access to systems or networks connected to the App
• Interfere with or disrupt the integrity or performance of the App
• Create derivative works based on the App or its content without our express written permission

The App displays third-party fragrance and brand names and related catalog information for identification and informational purposes. These names, trademarks, and other marks belong to their respective owners. Unless expressly stated otherwise, The ScentStack is not affiliated with, endorsed by, sponsored by, or officially connected with any fragrance brand referenced in the App. Catalog information is sourced from third-party providers and manual curation; we make reasonable efforts to keep it accurate but do not warrant that it is complete, current, or error-free.

The App — including its design, features, interface, source code, branding, and proprietary recommendation and layering technology — is owned by or licensed to The ScentStack LLC and is protected by copyright, trade secret, and other intellectual property laws. All rights not expressly granted in these Terms are reserved. We do not publicly disclose the internal workings of our recommendation technology.

You retain ownership of content you submit to the App, including your fragrance collection data and saved stacks. By submitting content, you grant us a limited, non-exclusive license to host, store, process, and display that content solely to operate and improve the App for you.

If you submit feedback, suggestions, or ideas about the App, you agree that we may use them without restriction or compensation to you.

The ScentStack provides fragrance layering recommendations and stack suggestions through its proprietary recommendation and layering technology, which may consider factors such as the fragrances you own, weather and environmental context, an occasion or vibe you select, and prior activity in the App, where applicable. These recommendations are provided for informational and lifestyle purposes only and are not guaranteed to produce any particular result. Results vary based on the specific product, your skin chemistry, environmental conditions, application method, individual sensitivity, and other factors outside our control. Always follow the manufacturer's instructions and warnings, and discontinue use of any product if you experience irritation or another adverse reaction. The ScentStack does not provide medical or dermatological advice. Fragrance catalog data is sourced from third-party providers and manual curation, and we do not warrant that it is complete, current, or error-free.

The ScentStack may offer Premium access through subscriptions or in-app purchases, made available through the Apple App Store or Google Play. The applicable store processes your payment under its own terms; we do not directly store your full payment card information. The ScentStack uses RevenueCat to support subscription entitlement management where Premium purchases are enabled. Premium access may expire if a subscription lapses or is cancelled. Cancellation generally affects future renewals and does not retroactively remove history created while Premium was active, which may remain viewable according to the App's current functionality. Purchase restoration is supported where the platform allows it. Subscription price, duration, any trial terms, renewal terms, and applicable taxes are presented through the applicable store's purchase interface. Cancellations and refunds are governed in part by Apple's and Google's own policies, since they process the transaction.

The ScentStack is currently available as a controlled beta. Features, functionality, and availability may change without notice, and you may encounter bugs, incomplete features, or interruptions in service during this period.

You may permanently delete your account at any time from within the App, in Settings. Deletion removes your account-associated data as part of the deletion process, where technically and legally applicable. Limited information may be retained where required by law, for fraud or security purposes, to resolve disputes, or for other legitimate operational or legal obligations.

You agree to indemnify, defend, and hold harmless The ScentStack LLC and its members, officers, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorneys' fees) arising out of or in any way connected with your use of the App, your violation of these Terms, or your violation of any rights of a third party.

We reserve the right to suspend or terminate your account and access to the App at our sole discretion, with or without notice, for any reason, including if we reasonably believe you have violated these Terms. You may delete your account at any time in Settings.

These Terms and any dispute arising out of or relating to these Terms or The ScentStack will be governed by the laws of the State of Wyoming, without regard to its conflict-of-laws principles.

Any legal action or proceeding arising out of or relating to these Terms shall be brought in the state or federal courts located in the State of Wyoming, and you consent to the jurisdiction of those courts.

We reserve the right to modify these Terms at any time. We will notify you of material changes by updating the effective date above and, where appropriate, by providing notice within the App.

If any provision of these Terms is found to be unenforceable or invalid, that provision will be limited or eliminated to the minimum extent necessary so that the remaining Terms will otherwise remain in full force and effect.

These Terms, together with our Privacy Policy, constitute the entire agreement between you and The ScentStack LLC regarding your use of The ScentStack and supersede all prior agreements and understandings on this subject.
